SalesPilot CRM – Terms of Use

Welcome to SalesPilot CRM, a service operated and provided by Mixed Media Ventures (“MMV”, “we”, “our”, or “us”). These Terms of Use (“Terms”) govern your access to and use of the SalesPilot CRM platform, whether accessed directly through MMV or via an authorized reseller. By continuing to access or use SalesPilot CRM, you agree to be bound by these Terms.
1. Applicability and Acceptance
These Terms apply to all individuals and entities (“users,” “you,” or “your”) who access or use SalesPilot CRM. This includes:
- Customers who purchase directly from MMV.
- End users who gain access through MMV’s authorized resellers.
If you access SalesPilot CRM via a reseller, you agree that these Terms apply in addition to any terms provided by the reseller. MMV is not responsible for obligations made by resellers outside these Terms.
2. Eligibility
You must be at least 18 years old and capable of forming a binding legal agreement to use SalesPilot CRM. By using the platform, you represent and warrant that you meet these requirements.
If you are using the platform on behalf of a business or other legal entity, you represent that you have the authority to bind that entity to these Terms.
3. Account Registration and Responsibilities
To access certain features, you may be required to register an account. You are responsible for:
- Providing accurate and complete information.
- Maintaining the security of your login credentials.
- All activity that occurs under your account.
MMV reserves the right to suspend or terminate accounts that violate these Terms or applicable laws.
4. License and Permitted Use
MMV grants you a limited, non-exclusive, non-transferable, revocable license to access and use SalesPilot CRM in accordance with these Terms.
You agree not to:
- Use the platform for any unlawful purpose.
- Reverse engineer, copy, or modify the software.
- Share access credentials or sublicense the platform.
- Misrepresent your identity or affiliation.
If you are a reseller, you must ensure that all your clients and sub-users also comply with these Terms.
5. Content and Data Use
You retain ownership of the content and data you input into SalesPilot CRM. By using the platform, you grant MMV a non-exclusive license to use, store, and process your content solely for providing and improving the service.
You are solely responsible for ensuring that:
- You have lawful rights to the data you submit.
- You comply with data privacy laws, including consent requirements under GDPR, CCPA, and other regulations.
6. Communications and Legal Compliance
If you use SalesPilot CRM to send communications (e.g., email, SMS, voicemail drops), you are responsible for compliance with applicable laws such as:
- The Telephone Consumer Protection Act (TCPA)
- CAN-SPAM Act
- GDPR and other international privacy laws
You must obtain clear consent before sending automated or promotional messages and must provide an opt-out mechanism.
7. Fees and Payments
Use of SalesPilot CRM may require payment of subscription fees. Unless otherwise stated:
- Fees are non-refundable.
- You are responsible for all applicable taxes.
If you purchased access via a reseller, fees and billing terms are governed by your agreement with that reseller.
8. Termination and Suspension
MMV may suspend or terminate your access to SalesPilot CRM at its sole discretion for violations of these Terms, legal requirements, or upon request from your reseller.
You may discontinue use at any time. Termination does not relieve you of any outstanding payment obligations.
9. Reseller Obligations
Authorized resellers of SalesPilot CRM must:
- Ensure their clients agree to these Terms.
- Not misrepresent the platform or their authority.
- Provide support and onboarding to their clients consistent with MMV’s brand and standards.
MMV reserves the right to revoke reseller access for non-compliance.
10. Intellectual Property
All content, software, and technology underlying SalesPilot CRM are the property of MMV or its licensors. You may not use MMV’s trademarks or brand elements without express permission.
11. Disclaimers
SalesPilot CRM is provided “as is” without warranties of any kind. MMV disclaims all implied warranties including merchantability, fitness for a particular purpose, and non-infringement.
12. Limitation of Liability
To the fullest extent permitted by law, MMV shall not be liable for indirect, incidental, special, consequential, or punitive damages. MMV’s total liability shall not exceed the amount paid by you for the service in the 12 months preceding the claim.
13. Indemnification
You agree to indemnify and hold harmless MMV, its affiliates, and employees from any claims arising out of your use of the platform, violation of these Terms, or breach of law, including claims related to your communications and data practices.
14. Changes to Terms
MMV may update these Terms from time to time. Updated versions will be posted on our website. Your continued use of the platform after changes are posted constitutes acceptance of the revised Terms.
15. Governing Law and Dispute Resolution
